100% Tax

This whole AIG fiasco...is just a complete farce. What it really shows is how the government has completely bungled the AIG takeover. Blame the Bush administration and the Obama administration. It also shows, once again, why the government shouldn’t run anything, because it cannot run anything.

AIG should have been placed in bankruptcy last fall under some sort of government sponsorship. While in bankruptcy, all the salary contracts (and every other AIG contract) would have been nullified and voided. At the same time, there would have been an orderly liquidation and sale of AIG’s assets and separate divisions.

—Larry Kudlow

I don't like the idea of tax money being used for multi-million dollar bonus checks, particularly when those millions are going to corporate executives who have driven their company into a ditch. This is why we shouldn't be handing out billions of taxpayer dollars to private corporations. Having said that, it's time to get some facts straight about the $165 million AIG mess.

1. The AIG employees recieved the payments in question persuant to contracts written last March (pre-TARP). The bonuses in these contracts were NOT based on performance.

2. AIG is headquartered in Wilton, Connecticut. In Connecticut they have a little gem called the "Wage Act." The state law allows employees to sue for twice the full amount of contractually owed wages plus attorney's fees, if an employer refuses to pay up. So...you're running AIG. What would YOU do?

3. The Democrat spendulus bill that was rammed down America's throat provided an extra layer of protection for these bonuses (thanks to AIG's bestest buddy, Democrat Chris Dodd). Oops! Our Democrat Congress and our Democrat POTUS have had considerable difficulty coming up with effective CYA maneuvers. In an act of despiration, Nancy Pelosi has proposed scandalously confiscatory legislation that would recover the bulk of these bonuses by taxing them at a rate of 90%. Ninety percent is barely enough as far as Chucky Schumer is concerned. "They should voluntarily return [the bonuses]. If they don't, we plan to tax virtually all of it," New York Sen. Schumer declared on the Senate floor.

4. Small problem with Madame Nancy's plan: it's unconstitutional. Article I, Section 9, clause 3 expressly forbids "bills of attainder." What's a bill of attainder? "It's a law that is written that is specifically aimed at an individual or small group of individuals, with the purpose of punishing or penalizing them in some fashion. It is also referred to as a 'private bill.' The British did this on a regular basis in the eighteenth century, which is one reason why the Constitution absolutely forbids it."

5. Not that congress actually cares about what the constitution says, but Article I, section 9 also prohibits the passage of ex post facto laws. "An ex post facto law is one that is passed after the event to which it relates has already occurred (another favorite strategy of the British). If Congress were to make the receipt of these bonuses taxable at a rate different than they are taxable now, and then enact a criminal penalty for the failure to pay, it would clearly be an ex post facto law and therefore would violate Article I."

The idea that Congress would even consider interfering with these contracts retroactively should be a grave concern for every one of us. And the idea that the government (with the support of a populist outrcry) would target a small group of individuals for a punitive 90% tax is extremely frightening to me. Who's next?!

AIG should honor its contractual obligations to its employees. Congress should stay out of it. Yes, it's depressing to witness this scandal, but let's not allow it to become a distraction. We should be much more concerned about Congress's insatiable, multi-billion dollar pork addiction. Let's get serious about saving taxpayer dollars: how about a 90% tax on porky earmark payouts?

Come on Nancy, make it happen! I'll make it easy for you. I've taken the liberty of borrowing your words; here's your press release:

"We must protect the American taxpayer from politicians who would use their constituents' crises as opportunities for private gain. Because Congress does not use sound judgment in the use of taxpayer funds, taxpayers will recover the bulk porky congressional indiscretions with a 90 percent rate of taxation on earmark payouts. I urge all my colleagues to vote in favor of this legislation and in favor of recovering taxpayer dollars and protecting Americans from the continued poor judgment of America's biggest spenders."

Dodd just admitted on CNN that he inserted a loophole in the stimulus legislation that allowed million-dollar bonuses to insurance giant AIG to go forward – after previously denying any involvement in writing the controversial provision. *All of the Democrats have to take responsibility for this, not just Chris Dodd. The Democrats and Mr. POTUS rammed this bill down America's throat. No time to read the bill, no time to debate the bill...just pass it! They promoted the bill, signed the bill, and to my knowledge, not one Democrat raised an eyebrow in reference to Dodd's "loophole."

You Have the Right to Remain Helpless

Welcome to the Obama Era. You should no longer worry about taking care of yourself. You should no longer expect to clean up your own messes.  Your bailout is on the way.  You have the right to remain helpless.

Now that Obama is your ruler, you can expect the government to evolve into a more dynamic and transformative element of your life.  Here's Obama complaining about our old fashioned Constitution:  "...the Constitution is a document of negative liberties, says what the states can't do to you, says what the federal government can't do to you, but it doesn't say what the federal government or state government must do on your behalf."

Obama wants you to demand more!  So, what has the government done for you lately? You have rights...have you cashed in?

"Time was, rights were defensive. They were to prevent government from doing things to you. Today, rights increasingly are offensive weapons wielded to inflict demands on other people, using state power for private aggrandizement. The multiplication of rights, each lacking limiting principles, multiplies nonnegotiable conflicts..."

Questions for My Liberal Friends

Are there any intelligent, rational liberals in the world? If so, I'd like to ask a few questions:
  • Liberals asked Americans to hand the keys of government over to the Democrats in order to end the "Culture of Corruption." In light of the recent antics of Rod Blagojevich, William "Cold Cash" Jefferson, Charlie Rangel and other luminaries, what are liberals saying about the culture of corruption now?
  • Liberals do not seem to be bothered by Obama's associations with the likes of Tony Rezko, Rod Bagojevich, William Ayers, Jeremiah Wright, and Rhashid Khalidi.  Why not?
  • What do you think about gun control in India as it relates to recent events in Mumbai?
  • As part of their strategy to deal with international Islamist terrorism, liberals want to address the grievances of the terrorists.  Are you familiar with the concept of operant conditioning?
  • Most Americans (70% of Republicans, 62% of independents and 55% of Democrats) oppose the auto industry bailout plan, yet Democrats in Congress are poised to pass a bailout bill anyway. Why?
  • How high will the price of energy have to go before you are willing to support drilling in ANWR or expanding the use of nuclear energy and coal?
  • What kind of economy would be best for America?
                A.  Socialist.
                B.  Communist.
                C.  Fascist.
                D.  Capitalist.
  • Obama has stated that he is in favor of tax increases (for reasons of "fairness") even when they result in DECREASES in revenue for the government.  Do you support Obama's thinking on this issue?  What do you know about the Laffer Curve?
  • Do you still believe that Obama will increase the tax burden only for individuals making $250,000  or more per year?  Are you going to hold him to that promise?
  • Liberals support progressive taxation for redistribution of wealth.  With which other Marxist principles do you agree? With which Marxist principles do you disagree?
  • Obama has outlined a intentionally vague health care agenda.  His health care czar, Tom Daschle wants to push a bare-bones health care bill through congress as soon as possible after Obama is elected.  A Federal Health Board would be charged with establishing the system's framework and filling in most of the details. This independent board would be insulated from political pressure.  Does this in any way strike you as undemocratic?
  • Liberals have consistently opposed voter identification laws aimed at reducing voter fraud.  Why?
  • Many Americans (particularly minorities) say that their children are trapped in failing schools.  Nationwide, 52 percent of parents, and 59 percent of public school parents, support school choice.  87 percent of black parents aged 26-35 and 66.4 percent of blacks aged 18-25 support vouchers.  Liberals consistently oppose school choice.  Why?
  • Obama was asked, "At what point does a baby get human rights?" His response: "...answering that question with specificity, you know, is above my pay grade." Based on his leadership in opposition to the Illinois Born Alive Infants Protection Act, Obama has demonstrated that he believes that a baby gets human rights at an unspecified time AFTER he or she is born.  My question to liberals: is infanticide acceptable?
  • Is there anything Obama could do to lose your support?  If so, what?

Obama's Ultimatum

He's president-elect of the United States of America, but we barely know who he really is.  For someone who has risen so far, Barack Obama has been in the public view for a remarkably short period of time.  So we speculate about what kind of president he will be.  Will he be a centrist or a leftist?  Will he be a friend of capitalism or will he aggressively shove us toward socialism?  What is his agenda?

Now that the campaign is over, we can assume that Obama isn't just trying to win votes every time he opens his mouth.  So who is Obama? Let's take him at his word. Here are some fresh quotes with some analysis from yours truly:

" ...part of what I'm hoping to introduce as the next president is a new ethic of responsibility where we say that if you're laying off workers, the least you can do when you're making $25 million a year is give up some of your compensation and some of your bonuses ... That kind of notion of shared benefits and burdens is something that I think has been lost for too long, and it's something that I'd like to see restored."

Here Obama is reinforcing the idea of spreading the wealth (and the misery).  He is also telling us that he should should have a say in how America's businesses are run.

Next quote:

"...sometimes when we start talking about taxes, and I say I want a more balanced tax code, people think, well, that's class warfare. No. It turns out that our economy grows best when the benefits of the economy are most widely spread. And that has been true historically."

More redistributionism.  Apparently this is very important to Obama.  Don't forget it.

Here's an Obama quote regarding the bailout of the Big Three auto companies and the executives' willingness to agree to Obama's prescribed "reforms":

"If this management team that's currently in place doesn't understand the urgency of the situation and is not willing to make the tough choices and adapt to these new circumstances then they should go."

There he goes again.  This time with an ultimatum. Good thing Obama knows best.

So how does this all add up?  Is Obama an aspiring capitalist, socialist, communist or fascist?  Let's review the terms:

  • Capitalism:  an economic system characterized by private or corporate ownership of capital goods.
  • Socialism:  a system or condition of society in which the means of production are owned and controlled by the state.
  • Communism:  a system in which goods are owned in common and are available to all as needed.
  • Fascism: Strict regulation and control of the economy through some form of corporatist planning in which the legal forms of private ownership of industry are nominally preserved but in which both workers and capitalists are obliged to submit their plans and objectives to the most detailed state regulation and extensive wage and price controls.
As Obama and his friends in Congress talk about appointing a car czar to oversee the auto industry, let's think very carefully about where this country is headed.

Bailout Frenzy

Who says Obama doesn't look like the guys on the dollar bills?  Slap on a wig and he looks just like Thomas Jefferson.

So the bailout misadventure continues.  This time it's speaker of the house, Madame Pelosi, who's out there brandishing the bailout bucket.  Some questions: What will we ultimately accomplish with all these bailouts? Where does this stop?  When do I get my bailout? If EVERYBODY gets a bailout, doesn't that take us right back to square one?

Thinking about this reminds me of what Wintston Churchill said: "We contend that for a nation to tax itself into prosperity is like a man standing in a bucket and trying to lift himself up by the handle."  The same concept applies to government bailouts.
